For a Georgia financial Power of Attorney executed under the Georgia Uniform Power of Attorney Act, the document generally must be signed by the principal, attested by at least one competent witness, and attested before a notary public or other person authorized to administer oaths.The person acting as the notary cannot also serve as the required witness for that execution.Because document requirements can vary, we do not determine which legal document or execution method you should use. If your Power of Attorney requires a witness, tell us when scheduling so we can discuss availability and any additional witness fee. For a Georgia financial Power of Attorney governed by O.C.G.A. § 10-6B-5, the notary performing the notarization cannot also act as the required witness.

Being elderly, hospitalized, or physically ill does not by itself prevent someone from receiving notary service.However, the signer must be able to participate voluntarily, and the notary must be satisfied with the signer's identity and the circumstances of the signing. Georgia's notary guidance says a notary should refuse when there is a question regarding identity, sanity, or voluntariness.For hospital or care-facility appointments, contact us beforehand so we can discuss access, identification, witnesses, and appointment logistics.

Yes. The person whose signature is being notarized must personally appear before the notary for the notarial act.The notary must confirm the signer's identity and complete the appropriate notarial certificate.
